which iphone to buy – jailbroken or factory unlocked and where to buy in USA?

A friend is visiting chicago next week and I want him to buy and iphone 3gs 16gb for me, since its cheaper there than here in india.
I know that Apple sells iphones only with at&t contract, so how and where can a tourist buy an iphone. Also, if one gets options, which one to buy….. the factory unlocked or the jailbroken and with which version(3.0 or 3.1.2 or 3.1.3). I have also heard that certain iphones once unlocked are locked again after restarting due to some improper unlocking/jailbreaking or firmware version based issues.
Please help.
I am hopeful to get it within $600… is it possible.
You need an unlocked iPhone. They are not sold on retail in North America. Factory unlocked iPhones are occasionally found online. They are permanently unlocked. Jailbroken and unlocked iphones are sold on sites like eBay. They are easily relocked.
Apple is currently selling iPhones without a contract. The 3gs 16gb is $599. However, they are all locked to AT&T and Apple will not unlock an iPhone. They are all running 3.1.3 and cannot be jailbroken or unlocked.
